1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Therapyy ("we," "us," or "our") governing your access to and use of our website at therapyy.in and all associated mobile applications, APIs, and services (collectively, the "Platform").

By creating an account, booking a session, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

To use the Therapyy Platform, you must:

• Be at least 18 years of age
• Be a resident of India or using the Platform in connection with a child residing in India
• Have the legal capacity to enter into a binding agreement
• Not have been previously suspended or removed from the Platform

Parents and guardians using the Platform on behalf of a minor child represent that they have full legal authority to do so and accept these Terms on the minor's behalf.

3. User Accounts

3.1 Account Registration

You must register for an account to access core Platform features. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@therapyy.in if you suspect any unauthorized use of your account.

3.3 One Account per User

Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions, policies, or suspensions is prohibited and may result in permanent removal from the Platform.

4. Platform Services

Therapyy is a technology platform that connects parents and caregivers of children with neurodevelopmental needs to qualified therapists, psychologists, and other healthcare professionals. We provide:

• A marketplace to discover and book verified therapy professionals
• GrowthVault, a secure child developmental record system
• Online video, voice, and chat sessions facilitated through Twilio
• AI-assisted developmental insights and session summaries
• Payment processing and wallet services via Razorpay
• Parent training programs including ABA-based content

Therapyy is a platform intermediary, not a healthcare provider. We do not provide medical diagnoses or clinical treatment. All clinical decisions remain the responsibility of the licensed professionals on the Platform.

5. Parent Obligations

As a parent or caregiver using the Platform, you agree to:

• Provide accurate and honest information about your child's developmental history, diagnoses, and needs
• Attend or facilitate booked sessions on time and notify therapists of cancellations at least 24 hours in advance
• Use the Platform solely for legitimate therapeutic purposes for your child
• Not record sessions without the explicit written consent of the therapist
• Treat all therapists with respect and professionalism
• Not attempt to contact therapists outside the Platform using information obtained through the Platform
• Keep all session content, session notes, and therapist communications confidential

6. Therapist Obligations

Therapists registered on the Platform agree to:

• Maintain valid RCI registration, licensure, and any other applicable professional credentials throughout their time on the Platform
• Provide services only within their scope of practice and competence
• Complete all sessions booked through the Platform unless genuine clinical contraindications exist
• Maintain accurate and timely session notes in compliance with professional standards
• Comply with all applicable laws including DISHA, the Mental Healthcare Act 2017, and RCI regulations
• Not solicit parents or caregivers to move sessions off the Platform
• Report any safeguarding concerns regarding a child to the appropriate authorities immediately

7. Payments and Refunds

7.1 Payment Processing

All payments on the Platform are processed through Razorpay. By making a payment, you agree to Razorpay's terms of service. Therapyy charges a platform commission of 15% on all session fees, which is deducted automatically before therapist remittances.

7.2 Wallet

The Platform uses a prepaid wallet system. Funds added to your wallet can be used to book sessions. Wallet balances are non-transferable and cannot be withdrawn by parents.

7.3 Refund Policy

• Cancellations made more than 24 hours before a session: full refund to wallet
• Cancellations made within 24 hours of a session: 50% refund to wallet
• No-shows (parent or child does not attend without notice): no refund
• Therapist-cancelled sessions: full refund to wallet within 24 hours
• Technical failures attributable to Therapyy: full refund to wallet

7.4 Disputes

Payment disputes must be raised within 7 days of the session date by contacting support@therapyy.in. We will investigate and respond within 5 business days.

8. Health Data and Privacy

The Platform processes sensitive personal data including children's health records, developmental assessments, and session notes. Our collection, use, and protection of this data is governed by our Privacy Policy and DISHA Compliance Statement.

You retain ownership of all health data relating to your child. We are data processors acting on your instruction. We will never sell, share, or use your child's health data for advertising purposes.

9. Prohibited Conduct

You must not use the Platform to:

• Impersonate any person or entity or misrepresent your qualifications or credentials
• Upload or transmit any content that is unlawful, harmful, defamatory, or abusive
• Attempt to scrape, reverse-engineer, or copy any part of the Platform
• Interfere with or disrupt the security, integrity, or performance of the Platform
• Circumvent any access controls or attempt to gain unauthorized access to any part of the Platform
• Use the Platform for any commercial purpose unrelated to legitimate therapeutic services
• Share referral codes, credentials, or access in violation of these Terms

10. Intellectual Property

All content on the Platform, including text, graphics, logos, software, and the GrowthVault system, is owned by or licensed to Therapyy and protected under Indian and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

11. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Therapyy disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Therapyy does not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Clinical outcomes depend entirely on the individual child, the therapist, and parental engagement, and we make no representations regarding therapeutic outcomes.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Therapyy and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Platform.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount you paid to Therapyy in the 3 months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Therapyy and its officers, directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users, therapists, or the Platform. Upon termination, your right to access the Platform ceases immediately. Any outstanding wallet balance will be refunded subject to applicable deductions.

You may delete your account at any time by contacting support@therapyy.in. We will process your request within 30 days.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
